Liability for Links
This site contains links to third-party Web sites. We have no influence over the information contained in these Web sites and we give no guarantee as to their accuracy or decency. The content of such third-party sites is the responsibility of the respective owners/providers. At the time third-party Web sites were linked to ours, we found no grounds to indicate a contravention of the law. We shall quickly delete a link if we become aware that it violates the law.
It is most important that our clients obtain all the necessary permissions and authorities in respect of the use of copy, graphic images, photography, company logos, names and trademarks or any other material they supply to Eyeberia for inclusion on the website or in other marketing material. We shall not be responsible for any claims that may be made should a client fail to do this.
Correction of Errors
We will correct Website errors (or ‘bugs’) free of charge for 6 months from the date of launch.
Hosting is invoiced annually in advance. Email hosting and increased bandwidth can be provided at additional cost.
Clients wishing to provide their own hosting must include: Linux/Unix Server with .htaccess configuration support, Cpanel, PHP5 scripting, a MySQL5 database, and full FTP access to the hosting account.
Websites will be built to work in the following browsers: Internet Explorer 7, 8 and 9; Firefox 3; Google Chrome and Safari. Support for additional browsers (e.g. older or mobile) must be agreed before work commences.
Proposals and Offers
Our proposals are valid for 30 days from the date of issue. All offers and proposals made by Eyeberia are confidential information and remain the property of Eyeberia. Our offers and proposals and the information contained within them must not be passed to third parties.
If payment has not been received within 30 days of the due date, Eyeberia reserves the right to suspend ongoing work for the client until the outstanding balance has been received. Eyeberia may remove or take down work if payment has not been recieved 45 days after the due date.
Right to Terminate
Eyeberia reserves the right to refuse or break a contract without prior notice, if it is believed that the client, their website, or any material therein is illegal, immoral or deemed to be unacceptable to Eyeberia.
Cancellation of orders for work with Eyeberia should, in the first instance, be made by telephone, but must be confirmed in writing by e-mail or letter. The client will be invoiced for any work completed up to the date of the first notice of cancellation and should be payed in full within 28 days. The full invoiced amount of the order must be paid if the cancellation is not received in writing within 10 working days.
Impossibility of Performance
The client acknowledges and agrees that Eyeberia cannot be responsible for the absence of service caused by Acts of God or other circumstances beyond its control including, but not limited to, telecommunications problems.
Acceptance of Terms and Conditions
The placement of an order or contract with Eyeberia will be regarded as an acceptance of all the above terms and conditions. Orders may be placed, in the first instance, by telephone or e-mail and must be confirmed in writing by e-mail or by letter.
